Process for Obtaining 101 Recovery Certificate to be Expedited


The process for obtaining the essential 101 recovery certificate for overdue loan recovery by cooperative credit societies in Maharashtra is set to become faster and more efficient. Mr. Shailesh Kotamire, the Cooperative Commissioner and Registrar of Cooperative Societies, Maharashtra State, Pune, has issued a revised guideline circular dated May 14, 2024, to address this.

The following instructions have been issued to expedite the issuance of the 101 recovery certificate for cooperative credit societies and banks:


1. Error-Free Cases: For cases without any errors, a hearing notice will be issued within three days of filing.

2. Cases with Errors: For cases that contain errors, the deficiencies must be corrected within ten days of filing, after which the hearing notice will be issued.

3. Issuance of Recovery Certificate: Ensure the recovery certificate is issued within three months from the date of the first hearing.

4. Documenting Delays: If the process takes longer than three months, the reasons for the delay must be documented in the order.

5. Monthly Review: District Deputy Registrars should review the recovery certificate cases under their jurisdiction on a monthly basis.

6. Disciplinary Action: If a recovery certificate is not issued within three months without a valid reason, disciplinary action should be proposed against the responsible registrar.

7. Divisional Review: Divisional Joint Registrars should conduct a monthly review of pending recovery certificate cases that extend beyond three months.

8. Inspection Reports: During office inspections, the current status should be recorded in the inspection reports.

9. Review Meetings: District Deputy Registrars should organize review meetings with representatives of urban/rural non-agricultural cooperative credit societies every three months to resolve any issues related to Sections 101, 156, 100-85, upset price determination, and recovery matters.

These revised guidelines are expected to make the recovery process more efficient, transparent, and accountable, thereby assisting cooperative credit societies and banks in timely loan recovery.
